1. Acceptance of Terms

By accessing or using BuildOrBust (buildorbust.app), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. We may update these terms at any time, and continued use of BuildOrBust after changes constitutes acceptance of the revised terms.

2. Description of Service

BuildOrBust is an AI-powered SaaS idea validation tool. The service generates market analysis reports including viability scores, competitor analysis, keyword data, market gap identification, and go-to-market recommendations.

All reports are generated by artificial intelligence and are provided for informational and educational purposes only. Reports do not constitute financial advice, business advice, investment advice, or professional consulting of any kind. You should not rely solely on BuildOrBust reports when making business decisions.

3. User Accounts

To use BuildOrBust, you must create an account via Google OAuth sign-in. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to provide accurate information during the sign-in process.

You must be at least 16 years old to create an account and use this service.

4. Free and Paid Tiers

BuildOrBust offers two tiers:

Free Tier: 5 lifetime validation reports. Each report includes a viability score, basic competitor overview, and top keywords. Free reports do not include full market analysis, gap analysis, GTM playbook, social proof signals, or risk assessment.

Pro Tier: Subscription-based access providing up to 15 full validation reports per week. Pro reports include all sections: full competitor deep-dive, keyword analysis, market gaps, social proof signals, distribution channels, risk assessment, and build estimates.

5. Payment Terms

Pro subscriptions are billed on a recurring basis (weekly or monthly, depending on your selected plan). All prices are listed and charged in US Dollars (USD). You authorize us to charge your selected payment method for the subscription fee at the start of each billing period.

Payments are processed by our third-party payment processor. We do not store your credit card or payment card information on our servers.

6. Refund Policy

If you have questions about what you are purchasing before completing a transaction, please contact us at hello@buildorbust.com. We are happy to explain exactly what is included before you buy.

You may cancel your subscription at any time to prevent future charges. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then.

7. Intellectual Property

Reports generated by BuildOrBust belong to you, the user. You may use, share, or publish your reports however you wish, including making them publicly visible through the BuildOrBust community feed.

The BuildOrBust platform, including its design, code, branding, and underlying technology, remains the intellectual property of BuildOrBust. You may not copy, reproduce, or redistribute any part of the platform itself.

8. AI Disclaimer

BuildOrBust reports are generated by artificial intelligence (Anthropic Claude). While we strive for accuracy, AI-generated content may contain errors, inaccuracies, outdated information, or hallucinated data points.

Specifically:

- Competitor information may be incomplete or inaccurate.

- Keyword volume estimates are approximations, not exact figures from search engine databases.

- Market size estimates (TAM/SAM/SOM) are AI-generated approximations.

- Social proof signals reference real platforms but specific posts may not exist.

- Viability and clarity scores reflect AI analysis and should not be treated as definitive assessments.

We strongly recommend using BuildOrBust reports as one input among many when evaluating business ideas. Always conduct your own research and consult qualified professionals before making significant business or financial decisions.

9. Limitation of Liability

BuildOrBust is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall BuildOrBust, its owner, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or business interruption, arising out of or related to your use of the service.

Our total liability to you for any claims arising from your use of BuildOrBust shall not exceed the amount you paid to us in the 30 days preceding the claim.

10. Prohibited Uses

You agree not to:

- Use automated tools, bots, or scripts to access BuildOrBust or generate reports in bulk.

- Scrape, crawl, or extract data from the platform in any automated manner.

- Resell, redistribute, or commercially exploit BuildOrBust reports as a competing service.

- Attempt to reverse-engineer the platform, its AI prompts, or its scoring algorithms.

- Use the service for any illegal purpose or in violation of any applicable law.

- Interfere with or disrupt the service or its servers.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms of Service, suspected fraudulent activity, or abuse of the platform.

You may delete your account at any time by contacting us at hello@buildorbust.com. Upon deletion, your reports and personal data will be permanently removed.

12. Changes to Terms

We may modify these Terms of Service at any time. We will update the “Last updated” date at the top of this page when changes are made. Continued use of BuildOrBust after any changes constitutes acceptance of the new terms. It is your responsibility to review these terms periodically.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or relating to these terms or your use of BuildOrBust shall be subject to the exclusive jurisdiction of the courts of Ukraine.
